Located entirely within Hardiness Zone 7a, the Town of Herndon has eleven neighborhood parks and trails. With such beautiful trails and greenery, Herndon has established a tree ordinance to protect its trees and provide guidelines for their removal.

Tree Removal Permit Regulations for Residential Private Property

Private, commercial, and multi-family property owners in the Town of Herndon must acquire a tree removal permit for the lawful removal of protected trees within a Resource Protection Area (RPA).

In the absence of an RPA, property owners within the Town of Herndon ARE NOT required to attain a tree removal permit or notify the Town of the removal of trees on their property.

The following offers guidance for lawful tree removal and how to handle fallen trees.

Troubled, Diseased, Dead or Dying Trees – These trees (once identified by a property owner) should be addressed as quickly as possible.

The Town of Herndon’s Community Forester may require (by official notification) that a property owner take action on such a tree. Especially in cases where the tree poses an eminent threat to structures, people, and its surrounding ecosystem.

Typically the property owner is given 15 days to comply with the notification. Noncompliance is considered unlawful, and after such time has elapsed, the Town shall have the authority to remove such tree and charge the cost of that removal to the owner.

Protected Tree(s) on Private Property – Trees found along streams, watershed, easements, or other Resource Protection Areas (RPA) will require submission of an RPA permit application before any trimming, pruning, or removal activities may be performed.

For landscape improvement or construction, that is located on land that includes a Resource Protection Area, an RPA permit must be acquired.

Fairfax County’s Land Development Services – Customer and Technical Support Center should be contacted at (703) 222-0801 (option 2) for permitting and land disturbance support.

When in doubt, the Town’s Community Forester can be contacted to evaluate the location of the tree and offer further guidance.

Tree (on Town Property) Falls Onto Private Property – In this case, immediately notify the Community Forestry Department of the Town of Herndon at (703) 787-7380. A crew will be dispatched to remove the tree (in most cases, they will remove the tree in its entirety).

If the fallen tree caused physical damage to structures, inflicted bodily harm, or death on any person, file a claim using an e-claim form or mail a claim form to the Town Attorney (within 6 months of the occurrence). Pictures should be taken of the damages along with detailed documentation.

Tree (on Private Property) Falls Onto Town Property – The property owner is responsible for the portion of the tree up to the property line. After having notified the Community Forestry Department, they will dispatch a crew to remove the portion of the tree on Town property up to the private property line.

The Town will document any physical damage to structures, bodily harm, or death caused by the tree’s falling. Subsequently, the Town Attorney may file a claim against the property owner’s insurance policy.

Tree (on Private Property) Falls Onto Adjacent Private Property – The property owners are responsible for the portion of the tree that is on their respective property. Each should contact their homeowner’s insurance providers.

From where the tree(s) originated is irrelevant. However, if the property owner was previously notified of the tree posing an immediate threat, that property owner may be responsible for any and all resulting damages and injuries.

The San Jose Tree Removal Application Process

For the removal of ordinance-size trees, a permit application will only be considered for approval upon verification of one or more of the following:

  • The tree is dead, dying, or diseased
  • The tree limits or restricts the development or improvement of a parcel
  • The tree has become a safety hazard
  • The tree is unsuitable

Application Instructions

Make certain that the following requirements are satisfied when you submit your San Jose Tree Removal Permit Application Form:

  • Tree description and site plan (pages 3 & 4 of the application form)
  • Color photograph of each tree (showing the entire tree) printed on 8.5” X 11” paper.
  • Pay the non-refundable fee if required: Checks made payable to: City of San Jose. (See screenshot below for fees)
  • After review, City staff may require an arborist report. If you have already acquired one, it may be included with your submission.

NOTE: 2 days before removing a tree or having a stump removed, it is recommended to call 811. This free call will notify local utility companies that you intend to dig. They will come to your project site and mark any existing underground lines. The marks remain valid for a period of 28 days.

The City is known for its lavishly green landscape, thus nicknamed “City in a forest”.

Atlanta takes care of, protects and values its trees. There are regulations and requirements governing the removal of trees from private property. City of Atlanta Tree Removal Permit Application Process

These steps will assist you in the lawful removal of dead, dying, diseased or hazardous trees from private property.

1. Submit an Application:

Fill out and submit a tree removal permit application. Applications can be mailed, faxed, emailed or delivered in person to the City of Atlanta Arborist Division (contact info on the PDF).

2. Inspection:

Generally, within 5 business days, an assigned arborist will visit and complete a field inspection.

3. Application Approval:

When the application is approved, the field inspection report will be returned to you and must be on site while the tree removal process takes place.

* In the event the permit application is denied, an appeal can be filed.

How to Appeal a Permit Denial

When a tree removal permit is denied, an appeal may be made to the Tree Conservation Commission. Valid appeals must provide clear evidence of misinterpretation of the facts.

Parkersburg’s weather ranges from very cold and snowy winters to hot and humid summers, known as a humid continental climate. The city finds itself in zone 6b of the US Plant Hardiness Zone Map as well as being in the 3rd most heavily forested state in the union.

Parkersburg does not heavily regulate trees on private property. It does however, require that home and land owners maintain proper trimming and pruning of the trees adjacent to their property. Handling Emergency Tree Situations – Power Lines, Public Property, Sidewalks, City Streets

The City of Parkersburg Public Works Department is responsible for the care, trimming, and removal of all trees on the City’s public right of way (unless adjacent to private property). Listed below are varying cases for the removal of dead, dying or hazardous trees, and how they are to be addressed:

Public Tree Blocking Road or Impeding Traffic – When a storm-damaged limb or fallen tree is encountered in the roadway or impeding traffic, the City’s Public Works Department should be contacted at (304) 424-8568 during business hours.

Outside of business hours and holidays, contact the Parkersburg Police Department at (304) 424-8444, or the Parkersburg Fire Department at (304) 424-8470. In the event of physical damage, personal injury, or an after hours emergency, call 911 for Emergency Services.

Tree Blocking Sidewalk or Driveway – If a fallen tree or large limb is blocking a sidewalk or driveway, the City’s Public Works Department should be contacted at (304) 424-8568.

The Public Works Department will cut the portion of the tree blocking the public right of way. The portion on private property will remain for the property owner to handle.

Note: Trees along side or bordering sidewalks are the responsibility of the property owner of which they are adjacent to.



Tree Fallen on Private Property – If a tree or branch from an adjacent public right of way falls onto your yard or private property, and is not blocking the public right of way, the responsibility to have the tree removed is yours.

Power Line or Utility Interfering Tree – Mon Power will trim back or remove interfering trees. Residents should report power outages and trees that pose a hazard to utilities and power lines to Mon Power at (888) 544-4877, or contact them online here.

Public Tree Diseased, Dead or Dying – If there appears to be a dead or dying tree on city property that needs to be checked for removal, the City’s Public Works Department should be contacted at (304) 424-8568.

Private Tree Fallen on Public Property – If a tree from your yard or private property falls onto public property, the City’s Public Works Department should be contacted at (304) 424-8568.

Note: The City will only cut up the portion of the tree in the public right of way and set it aside for the property owner to resolve. Ultimately, the disposal of the tree in its entirety is the property owner’s responsibility.
